Agate Precious Metals

Anti-Money Laundering Policy

Agate Precious Metals is committed to conducting legitimate precious-metals transactions and taking reasonable steps to prevent its business from being used for money laundering, terrorist financing, fraud, sanctions evasion, or other unlawful activity.

This public policy explains the information we may request, circumstances that may require additional review, and customer responsibilities when buying products or selling precious metals to Agate.

1. Purpose and Scope

This policy applies to purchases, authorized bullion buybacks, payment reviews, and related business dealings with Agate Precious Metals.

We apply the legal obligations relevant to our activities. Requirements may differ according to the products involved, payment method, transaction structure, parties, and source of the precious metals.

This policy does not represent that Agate is a bank, money transmitter, government-certified dealer, or financial adviser. It does not guarantee that any transaction will be accepted.

2. Customer and Business Verification

Depending on the transaction and applicable requirements, we may request information reasonably necessary to confirm identity, payment authorization, ownership, or business purpose.

  • Legal name and current contact information.
  • Billing and delivery addresses.
  • Government-issued identification when needed for verification or legally required reporting.
  • Business identity and the authority of the person acting for a company or another party.
  • Information about the source of funds or precious metals when appropriate to the review.
  • Taxpayer identification information when legally required, collected through an appropriate process.

Verification requests do not necessarily indicate wrongdoing. Incomplete, inconsistent, or unverifiable information may delay or prevent a transaction.

3. Payments and Transaction Integrity

Customers must use payment methods accepted by Agate and provide accurate payment and order information.

  • Use funds and payment accounts you own or are authorized to use.
  • Disclose when you are acting for another person or business if that information is requested.
  • Do not submit false names, altered documents, misleading invoices, or unauthorized payment information.
  • Third-party payments, unusual payment arrangements, and changes to payment or delivery instructions may require additional review.

This policy does not expand the payment methods available at checkout or mean that Agate accepts physical cash for every transaction.

4. Cash Reporting and Recordkeeping

Where required, Agate will obtain the necessary information and submit applicable reports to the appropriate authorities.

Federal rules generally require a trade or business receiving more than $10,000 in cash in one transaction or related transactions to file IRS/FinCEN Form 8300. The legal definition of cash can include certain monetary instruments; it is not limited to currency.

A purchase exceeding $10,000 is not automatically reportable on Form 8300 merely because of its price. Payment method and the applicable rules determine the obligation. Bank wire transfers are not cash for Form 8300 purposes.

Related payments may need to be combined under the reporting rules, including connected transactions occurring more than 24 hours apart. We maintain required records and provide required customer statements as applicable.

Learn more in the IRS Form 8300 reference guide.

5. No Evasion of Reporting or Verification

Do not divide payments, orders, purchases, or buybacks for the purpose of evading reporting or verification requirements. Do not ask our employees to omit information, create inaccurate records, or misstate the parties or nature of a transaction.

Agate may decline arrangements intended to avoid applicable requirements and may make reports or disclosures where required or permitted by law.

6. Bullion Buybacks and Ownership

Anyone offering precious metals to Agate must own the items or have lawful authority to sell them. We may request purchase records, ownership information, identification, or other supporting documentation.

We may decline items associated with suspected theft, fraud, counterfeit products, unclear ownership, or unexplained discrepancies.

Buybacks require prior authorization and are subject to inspection, authenticity checks, and separately agreed terms. A buyback is a separate transaction from an ordinary return. See our Return & Refund Policy.

7. Additional Review and Restrictions

Transactions may receive additional review when information is inconsistent, payment arrangements are unusual, ownership is uncertain, or other circumstances raise fraud or financial crime concerns.

Agate does not knowingly enter transactions prohibited by applicable U.S. sanctions or other law. We may request further information to resolve a potential restriction.

Where lawful, we may pause fulfillment, request clarification, decline a proposed transaction, or cancel an order. Refunds, returns, and any handling of funds remain subject to applicable law and the relevant transaction terms.

We may be unable to disclose details of a review or report where disclosure is restricted by law.

8. Privacy and Information Handling

Information collected for verification and compliance is used for legitimate business, security, recordkeeping, and legal purposes. We may share information with providers supporting these purposes and with authorities when required or permitted by law.

Verification information is not an invitation to receive promotional communications. Marketing choices are handled separately.

For more information, read our Privacy Policy.

9. Policy Administration and Updates

Questions and concerns are directed to management for review. Agate may update this public policy as its operations, applicable requirements, or transaction procedures change.

This public summary does not disclose internal review methods and does not replace any written internal AML program, training, designated responsibility, or independent testing required by applicable law.
