1. Introduction

Agate Precious Metals (“we,” “us,” or “our”) respects your privacy. This policy describes our information practices and the choices available to you.

This policy is a disclosure of our practices. Where applicable law requires consent for marketing, cookies, or other processing, we request that consent separately.

2. Information We Collect

Information you provide directly

When you create an account, place an order, subscribe to communications, or contact us, you may provide:

  • Your name.
  • Billing and shipping addresses.
  • Email address and phone number.
  • Payment information submitted through our payment providers. We do not store full payment-card numbers on our servers.
  • Order details, purchase history, and product preferences.
  • Customer-service messages and information you choose to share.
  • Marketing preferences, consent records, and unsubscribe requests.

Information collected automatically

Our website and technology providers may collect:

  • IP address and approximate location.
  • Browser, device, operating-system, and language information.
  • Pages viewed, referring pages, and visit timestamps.
  • Clicks, scrolling, navigation, and other website interactions.
  • Cookie identifiers and similar browser or device identifiers.
  • Technical information used for security and troubleshooting.

Please do not send payment-card numbers, account passwords, Social Security numbers, or other sensitive information through ordinary email, contact forms, or website chat.

3. How We Use Your Information

We use information to:

  • Process payments and fulfill orders.
  • Arrange shipping, tracking, and delivery.
  • Send order confirmations, shipping notices, and other transaction-related communications.
  • Manage accounts and respond to customer-service requests.
  • Send product announcements, promotions, and other marketing communications according to your choices and applicable law.
  • Understand website use and improve shopping experiences.
  • Measure marketing effectiveness where permitted.
  • Detect fraud, abuse, security incidents, and technical problems.
  • Maintain business records and comply with legal obligations.
  • Record and honor communication and privacy preferences.

4. Promotional Emails and Text Messages

Optional marketing enrollment

You may opt in to Agate Precious Metals marketing through a clearly identified checkout option, subscription form, or another consent process. Email and text-message preferences may be managed separately.

Marketing may include new releases, product availability, special offers, promotions, and precious-metals updates. Consent to promotional communications is not a condition of purchasing from us.

Promotional emails

You can unsubscribe from promotional emails using the unsubscribe link included in those messages or by contacting [email protected]. We process unsubscribe requests within the period required by applicable law.

Promotional text messages

If you separately consent to our text-message program, Agate Precious Metals may send recurring promotional texts to the mobile number you provide, including through automated technology where disclosed and permitted. Message frequency varies. Message and data rates may apply.

Reply STOP to unsubscribe from promotional texts. Reply HELP for assistance, or contact [email protected]. You may also communicate a clear request to withdraw consent through our support team. We honor opt-out requests as required by applicable law. An opt-out may be followed by a non-promotional confirmation message.

Providing a phone number for an order or delivery does not automatically authorize promotional texts or marketing calls. Any marketing-call program requiring consent must obtain that consent separately.

Order and service communications

Marketing preferences are separate from communications needed to administer your orders, account, or customer-service requests. We may continue necessary non-promotional communications by an appropriate permitted channel after a marketing opt-out. Requests to stop texts or calls are handled according to their scope and applicable law.

5. How We Share Your Information

We do not sell or rent customer contact lists to third parties for their own direct marketing. We may share information with:

  • Payment providers: to authorize payments, process refunds, and help prevent fraud.
  • Shipping and fulfillment partners: to prepare and deliver orders and provide tracking.
  • Operational service providers: including hosting, customer support, email delivery, text-message delivery, and website maintenance providers.
  • Analytics providers: including Microsoft Clarity, as explained in Section 6.
  • Authorities and other recipients when necessary: to comply with law, respond to valid legal requests, protect rights and safety, or investigate fraud.

We use contractual and other appropriate safeguards for service providers handling information on our behalf. Some providers, including Microsoft, also process certain information under their own privacy statements.

Mobile information and consent records

We do not share mobile numbers or text-message opt-in information with third parties or affiliates for their own marketing or promotional purposes. We may provide the information necessary to vendors supporting our own messaging program, subject to appropriate restrictions.

Certain advertising-related disclosures may be classified as a “sale,” “sharing,” or targeted advertising under applicable privacy laws even when no money changes hands. Where those laws apply to our processing, you may exercise the corresponding choices described in Section 9.

6. Microsoft Clarity and Website Analytics

We use Microsoft Clarity to understand how visitors interact with our website. Clarity provides behavioral analytics, heatmaps, and session replay, which can show interactions such as clicks, scrolling, and navigation.

Clarity may collect device and browser information, IP-related location information, page and interaction data, and identifiers through first-party and third-party cookies or similar technologies. We use these insights to improve navigation, product pages, checkout usability, site performance, and security.

Microsoft receives information through Clarity and may use information as described in its privacy statement, including for advertising-related purposes. This can involve processing that differs from our use of operational vendors.

Learn more about Microsoft’s collection, use, and privacy choices in the Microsoft Privacy Statement.

Our analytics configuration should exclude or mask sensitive fields. Please do not enter sensitive personal information in website areas where it is not specifically requested for a legitimate transaction.

Where applicable law requires consent for analytics or advertising cookies, that consent must be obtained before the relevant technologies are activated.

7. Cookies and Tracking Technologies

We use cookies and similar technologies for shopping-cart functions, account access, security, preferences, analytics, and permitted marketing measurement.

  • Essential technologies: support functions such as cart operation, checkout, authentication, and security.
  • Preference technologies: remember selections and settings.
  • Analytics technologies: help us understand website performance and visitor behavior, including through Microsoft Clarity.
  • Advertising-related technologies: may support measurement or personalization where used and permitted.

You can manage cookies through your browser settings and any cookie-preference controls made available on our website. Blocking essential cookies may prevent shopping-cart, login, or checkout features from working correctly.

Contact us if you need assistance with available privacy choices. Where required, we honor applicable browser-based opt-out preference signals, including Global Privacy Control.

8. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These include encrypted website connections and access restrictions appropriate to our operations.

Payment providers process payment details through their systems. No website, transmission method, or storage system can guarantee complete security. Please contact us if you believe your account or information has been compromised.

9. Your Rights and Choices

Depending on your location and the laws applicable to our business, you may have rights to:

  • Access or obtain a copy of your personal information.
  • Correct inaccurate information.
  • Request deletion, subject to legal obligations and permitted exceptions.
  • Obtain information in a portable format.
  • Withdraw consent where processing relies on consent.
  • Opt out of applicable sale, sharing, or targeted-advertising processing.
  • Appeal a privacy-request decision where applicable law provides that right.

To submit a request, email [email protected]. Please identify the request and the email address associated with your account or order. Do not send sensitive identification documents unless we provide an appropriate secure process.

We may need to verify your identity or an authorized agent’s authority. We respond within applicable legal deadlines and notify you of permitted extensions when necessary. We do not discriminate against you for exercising applicable privacy rights.

Marketing email and text opt-outs are described in Section 4. Cookie and browser choices are described in Section 7.

10. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this policy, including order fulfillment, customer support, fraud prevention, dispute resolution, and legal, tax, accounting, or regulatory obligations.

Retention periods depend on the type of information and purpose. We may retain limited consent and suppression records to document preferences and prevent further unwanted marketing. Provider-held analytics information is also subject to the provider’s applicable retention practices.

11. Children’s Privacy

Our website and services are not directed to individuals under 18, and we do not knowingly collect personal information from children. If you believe a child has provided information, contact us so we can investigate and take appropriate action, including deletion where required.

12. Third-Party Links

Our website may link to third-party websites or services. Their information practices are governed by their own policies. Review those policies before providing information or using their services.

13. Changes to This Policy

We may update this policy to reflect changes in our practices, services, or applicable law. We will post the revised version and update the date above. Where required, we provide additional notice or obtain consent before applying material changes.

An updated policy does not retroactively create marketing consent for previous customers.
